Unfair Labor Practice Charge Settled (Phoenix)

On April 11, 2008, NFFE Local 1450 and HUD San Francisco Regional Office entered into a settlement agreement in which HUD admitted that it violated HUD Phoenix Field Office employees’ bargaining-unit rights under the Federal Service Labor Management Relations Statute by threatening an employee for pursuing a grievance under our collective bargaining agreement.

How did this start? A temporarily detailed supervisor to the Phoenix SWONAP division suggested on December 19, 2007, that a grievant would suffer an adverse consequence for pursuing a grievance.

The statements of this supervisor were made in front of the local Union representative during a grievance meeting. The statements made were calculated and created a chilling affect on all present and all who learned of the coercive comments.

NFFE 1450 Phoenix POR Ken Einbinder immediately suspected foul play and contacted NFFE 1450 President Elizabeth McDargh who filed a Unfair Labor Practice.

Per the settlement, HUD agreed to post a notice signed by the Phoenix Field Office Director to all HUD Phoenix employees for 60 days notifying them that employees have a right to pursue grievances, that Agency will not make comments to grievants suggesting adverse employment consequences for pursuing a grievance and that Agency will not interfere with, restrain, or coerce its bargaining unit employees in the exercise of any rights assured by the Federal Service Labor Management Relations Statute.
