10/10/2006 HUD REFUSES TO HONOR THEIR AGREEMENT!
Today NFFE 1450 filed an Unfair Labor Practice (ULP) with the Fair Labor Relations Authority (www.flra.gov) against HUD HR and legal counsel for failing to negotiate in good faith and for failure to comply with the LMA.
LMA Section 10.11(A) states that the parties will request that a mutually chosen arbitrator hear an arbitration case within 30 days of referral to the Federal Mediation and Conciliation Service (FMCS --- http://www.fmcs.gov).
HUD legal counsel (from a high-paid private law firm) originally agreed in April 06 to combine NFFE 1450 and AFGE grievances relating to FLSA violations. The Agency is now reneging on that agreement.
Given our prior two experiences with the agency stalling NFFE 1450 did not hesitate and compiled 30 pages worth of evidence to prove the agencies habitual management practice of stalling and obstructing the rights of bargaining unit employees.
